8. Risk, Safety, and Limitation of Liability:
This is the most legally sensitive section. Portuguese consumer law (Law No. 24/96) and EU product liability law (Decree-Law 383/89) do not permit complete exclusion of liability for personal injury or death caused by defective equipment. Clauses 8.1–8.3 limit liability as far as permitted by Portuguese law but cannot go further. This section must be reviewed by a Portuguese solicitor before publishing. The scope of limitation will need to be adjusted once insurance coverage is in place.
8.1 Assumption of Risk
Road cycling is a physical activity that carries inherent risks, including but not limited to: road traffic, road surface hazards, weather conditions, mechanical failure, physical exhaustion, and collision. By renting equipment from Velo Algarve and using it on public roads, you voluntarily assume all inherent risks associated with road cycling. You acknowledge that you are physically capable of, and sufficiently experienced in, road cycling to operate a high-performance road bicycle safely on the roads of the Algarve.
8.2 Renter Responsibility
You are solely responsible for:Your own safety and the safety of others while using the equipmentYour compliance with Portuguese traffic law and the Portuguese Highway Code (Código da Estrada)Carrying appropriate personal identification when ridingAssessing road and weather conditions before each ride and adjusting your activity accordinglyAny fines, penalties, or legal liability arising from your use of the equipment on public roads
8.3 Limitation of Liability
To the fullest extent permitted by applicable Portuguese law:(a) Velo Algarve excludes all liability for any loss, injury, damage, or death arising from your use of the rental equipment on public roads, unless such loss, injury, damage, or death is caused directly by our supply of defective equipment.(b) Velo Algarve's total liability to you in respect of any claim arising under or in connection with your rental shall not exceed the total rental fees paid by you for the relevant rental period.(c) Velo Algarve shall not be liable for any indirect, consequential, or economic loss, including but not limited to loss of earnings, loss of enjoyment, or costs of alternative arrangements arising from any failure or delay in delivery or collection.Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited or excluded under applicable Portuguese or EU law.
8.4 Equipment Insurance INSERT ONCE CONFIRMED:
Once Velo Algarve's commercial insurance is in place, insert here: details of what is covered, what the renter's residual liability is, and whether any damage waiver or excess applies. Until that time, the full replacement cost provisions in Clause 7.5 apply. We strongly recommend that all renters hold appropriate personal accident insurance and travel insurance that covers road cycling activities prior to their rental period. We do not require proof of insurance as a condition of rental, but we strongly advise it.8.5 Helmet UseA helmet is available as an add-on with your rental. Under Portuguese law, helmet use is not compulsory for non-motorised bicycles. However, Velo Algarve strongly recommends wearing a helmet at all times. If you decline to add a helmet to your booking, you do so at your own risk.
9. Punctures and Mechanical Issues
9.1 Minor Mechanicals
Each rental bike is equipped with a pre-loaded saddle bag containing TPU tubes, tyre plugs, spare SRAM AXS batteries, and a mini electric pump for self-sufficient roadside repairs. By accepting the rental, you confirm that you have sufficient mechanical knowledge to use this equipment, or that you accept the risk of being unable to do so.
9.2 Serious Mechanical Issues
In the event of a serious mechanical failure during your rental period that renders the bike unrideable and is not caused by your own actions, contact us immediately. We will assess the issue and, subject to the nature of the fault, provide a replacement or arrange for assistance. We are not liable for costs or losses arising from time spent off the bike due to mechanical issues beyond our control.
9.3 Damage Caused by Renter
Mechanical issues or damage caused by misuse, neglect, collision, or use in breach of these Terms are the financial responsibility of the Renter under the provisions of Clause 7.5.
10. Cancellation and Modifications:
EU consumer law (Directive 2011/83/EU) provides certain cancellation rights for online contracts. However, under Article 16(l), these rights do not apply to leisure services for a specific date or period. Road bike rental for specific dates should qualify for this exception, but this should be confirmed with a Portuguese solicitor.

In the event that we are unable to fulfil your booking due to circumstances beyond our control (including but not limited to equipment failure, severe weather, or force majeure events), we will notify you as soon as practicable and offer either a full refund or an alternative booking date. We will not be liable for any costs or losses beyond the refund of rental fees paid.

We reserve the right to terminate your rental without refund if, in our reasonable assessment, you are using the equipment in a manner that is dangerous, unlawful, or likely to cause damage to the equipment or harm to others.
12. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Portugal. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the Portuguese courts, unless applicable consumer protection law provides otherwise. In the event of a dispute, we encourage you to contact us in the first instance to seek resolution. Portuguese consumers also have the right to refer disputes to an authorised alternative dispute resolution (ADR) body. Information on ADR bodies in Portugal is available from the Direção-Geral do Consumidor at www.consumidor.gov.pt.
13. Amendments
We reserve the right to amend these Terms at any time. Amendments will be posted on our website at veloalgarve.com/terms/ and will apply to bookings made after the date of amendment. Bookings confirmed before any amendment remain governed by the Terms in force at the time of confirmation.
14. Severability
